Terms of Service

These Terms govern your use of the Arkhaven desktop software, browser extension, guardian portal (portal.arkhaven.app) and website (arkhaven.app), together the "Service". By installing or using the Service you agree to these Terms. If you don't agree, please don't use it.

1. Who may use Arkhaven

You must be at least 18 years old, or the age of majority where you live, to create a guardian account or install Arkhaven. You may install Arkhaven only on devices you own or are legally authorized to manage, for example as a parent or legal guardian of a minor, as an organization managing its own devices, or as an adult who has chosen to have an accountability partner.

2. Lawful and transparent use

You agree not to use Arkhaven to secretly monitor another adult without their consent, to stalk or harass anyone, or in any way that violates privacy, wiretapping, employment or other applicable laws. You are responsible for telling users of a managed device about Arkhaven where the law requires it.

3. Accounts and security

Keep your password, PIN and recovery codes confidential. You are responsible for activity under your account. Tell us promptly at hello@arkhaven.app if you suspect unauthorized access.

4. Plans, billing and the beta

Arkhaven is currently in early access. Some features may change, be limited or be unavailable. Paid plans, if offered, will be described at the time of purchase along with their renewal and cancellation terms. Prices shown on our website are planned prices and may change before launch. Joining the waitlist does not create any obligation to buy.

5. License

We grant you a personal, revocable, non-exclusive, non-transferable license to use the Service according to these Terms. You may not resell the Service, reverse engineer it except where the law permits, or use it to build a competing product.

6. Privacy

Our Privacy Policy explains what data we collect and how we use it. In short, activity data stays on the device unless you pair it with the guardian portal, and we never sell personal data.

7. No guarantee of protection

Arkhaven helps reduce access to unwanted content and supports healthy screen habits, but no filtering or monitoring tool is perfect. Content may be mis-categorized, and determined users may find ways around restrictions. Arkhaven doesn't replace adult supervision, conversation or judgment.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKHAVEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.

10. Termination

You can stop using the Service and delete your guardian account at any time. We may suspend or end access if you violate these Terms or misuse the Service. Sections that by their nature should survive termination will survive.

11. Changes

We may update these Terms. If a change is material, we'll give reasonable notice, for example by email or on this page. Continuing to use the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, except where your local consumer law says otherwise.
